CAN FOREIGNERS BUY A PROPERTY IN MEXICO?


In accordance with article 27, section I of the Political Constitution of the United Mexican States, foreigners are prevented from acquiring direct dominion of lands and waters in a strip of one hundred kilometers along the borders and fifty on the beaches,


Article 27, Mexican Constitution.
I. Only Mexicans by birth or naturalization and Mexican companies have the right to acquire ownership of lands, waters, and their appurtenances, or to obtain concessions for the exploitation of mines or of waters. The State may grant the same right to foreigners, provided they agree before the Ministry of Foreign Relations to consider themselves as nationals in respect to such property, and bind themselves not to invoke the protection of their governments in matters relating thereto; under penalty, in case of noncompliance with this agreement, of forfeiture of the property acquired to the Nation. Under no circumstances may foreigners acquire direct ownership of lands or waters within a zone of one hundred kilometers along the frontiers and of fifty kilometers along the shores of the country.
To obtain a real estate in Mexico it is necessary to do it through the constitution of a TRUST (Fideicomiso).

What is a TRUST?

It is a contract whereby a person called a Trustor transfers certain assets and / or rights to the Trust Institution (Banks), so that they can manage them in the terms agreed upon, by bringing the benefits thereof to a third party called the trustee.



What are the costs that you should take into account?

1. The cost of the permit issue by the Ministry of Foreign Affairs is of $13,910.00 MXP
2. The management fee of the FIDEICOMISO/TRUST, approximately is $450.00 USD + TAX YEARLY.
3. The creation of the FIDEICOMISO/TRUST, approximately is $450.00 USD + TAX (only paid the first time)
